RAZOM PLATFORM USER AGREEMENT

USER AGREEMENT RAZOM PLATFORM («SUBSCRIBE TO ARMY», «SUBSCRIBE TO THE ARMY»

We ask you to carefully read this Razom Platform User Agreement (hereinafter referred to as the Agreement), accept the responsibility imposed by it and confirm your full and unconditional agreement with its terms.

  1. TERMS AND DEFINITIONS 1.1. The social project «Razom Donation Platform» (hereinafter referred to as the Razom Platform) is a website on the Internet, located on the web pages https://razom.com and https://subscribetoarmy.com, owned and administered by the Administrator, and which allows transfers of charitable assistance directly to the accounts of the defense forces of Ukraine (military formations subordinate to the Armed Forces of Ukraine, the National Guard of Ukraine, the Territorial Defense Forces of the Armed Forces of Ukraine, as well as others formed in accordance with laws of Ukraine military formations, law enforcement and intelligence agencies, special purpose bodies with law enforcement functions, which are entrusted by the Constitution and laws of Ukraine with the functions of ensuring the defense of the state) (hereinafter referred to as the HF), which are open in the State Treasury Service of Ukraine. 1.2. Administrator – ALL-UKRAINIAN CHARITY FUND “CIVIL PLATFORM RAZOMYUA” (code according to the Unified State Register of Legal Entities 43604748, location and postal address: 01024, Kyiv, Bankova Street, Building 3, Apartment 33), which carries out modernization, development, administration and ensuring the functioning of the Razom Platform (“SUBSCRIBE TO ARMY”, “SUBSCRIBE TO THE ARMY”). 1.3. User – any person who receives or intends to receive information services of the Administrator and visits the Razom Platform, with further actions that certify the desire of such a person to make charitable transfers directly to the accounts of the military formations of the defense forces of Ukraine, which in turn are represented on the Razom Platform.

  2. GENERAL PROVISIONS 2.1. This Agreement is concluded between the Administrator and the User who visits the Razom Platform or has used or wishes to use one of the services provided within the Razom Platform. 2.2. In accordance with Articles 633, 638, 641 of the Civil Code of Ukraine, the Law of Ukraine "On Electronic Commerce", this Agreement is a Public Offer (Offer) for the conclusion of an Agreement for the provision of information services. 2.3. This Agreement is addressed to all Users who visit and use the Razom Platform, the terms of which are the same for all Users regardless of their status and without giving preference to one User over another. 2.4. By gaining access to the materials of the Razom Platform, the User is considered to have joined the of this Agreement and confirms his full and unconditional agreement with its terms, and certifies that he has read the Privacy Policy of the Razom Platform, which is posted on the websites https://razom.com and https://subscribetoarmy.com. 2.5. The use of materials and services of the Razom Platform is governed by the current legislation of Ukraine. 2.6. The Administrator has the right at any time to unilaterally change the terms of this Agreement and the Privacy Policy of the Razom Platform, by setting out the Agreement in a new version, which shall come into force from the moment of their posting on the websites https://razom.com and https://subscribetoarmy.com. If the User disagrees with the changes made, the latter is obliged to refuse access to the Razom Platform and stop using the materials and services of the Razom Platform. 2.7. The User accepts the provision that all materials and services of the Razom Platform or any part thereof may be accompanied by advertising. The User agrees with that the Administrator does not bear any responsibility and does not have any obligations in connection with such advertising.

  3. OBLIGATIONS OF THE USER AND TERMS OF USE OF THE RAZOM PLATFORM 3.1. The User agrees not to take actions that may be considered as violating Ukrainian legislation or international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead or may lead to disruption of the normal operation of the Razom Platform and/or its services. 3.2. Comments and other entries of the User on the Razom Platform must not contradict the requirements of the legislation of Ukraine and generally accepted norms of morality and morality. 3.3. The User is warned that the Administrator is not responsible for the User's visit and use of external resources, links to which may be contained on the Razom Platform website. 3.4. The User agrees that the Administrator is not responsible and has no direct or indirect obligations to the User in connection with any possible or incurred losses or damages related to any content of the Razom Platform, copyright registration and information about such registration, services available or obtained through external sites or resources, or other contacts of the User, which he entered using the information posted on the Razom Platform, or links to external resources. 3.5.is carried out in accordance with the legislation of Ukraine. Any claims, disputes, official appeals will be considered exclusively in accordance with the procedure provided for by this Agreement and the legislation in force in Ukraine. 4.8. The User agrees that he is solely responsible (and that the Administrator is not responsible to the User or any third parties) for any violation by the User of his obligations established by this Agreement, as well as for all consequences of such violations (including any losses or damages that the Administrator may incur). 4.9. The Administrator has the right, and the User is deemed to have consented, to the transfer of information about the User to the Administrator's partners with whom the Administrator has concluded relevant agreements. Such exchange of information is carried out exclusively in cases of initiating requests and (or) using (performing certain actions) the Razom Platform services by the User. 4.10. When completing the registration procedure on the Razom Platform, the User agrees to receive from the Administrator (Razom Platform) advertising and other information, including messages, telephone calls, SMS, MMS messages, Push messages, or information in any other way, in particular in messengers, about news, promotions, offers, surveys, etc. The User may refuse to receive advertising materials via remote communication channels, in accordance with clause 3.12 of this Agreement.

  4. FINAL PROVISIONS 5.1. All possible disputes arising from or related to this Agreement shall be resolved in accordance with the current legislation of Ukraine. 5.2. Nothing in the Agreement may be understood as establishing between the User and the Administrator an agency relationship, partnership relationship, joint activity relationship, personal employment relationship, or any other relationship not expressly provided for in this Agreement. 5.3. Recognition by a court of any provision of this Agreement as invalid or unenforceable shall not entail the invalidation of other provisions of this Agreement. 5.4. Inaction on the part of the Administrator in the event of a violation by any of the Users of the provisions of this Agreement shall not deprive the Administrator of the right to take appropriate actions later to protect its interests and copyrights to the materials of the Razom Platform, which are protected in accordance with the legislation of Ukraine. 5.5. The Administrator has the right to disclose any information about the User that it deems necessary to comply with the provisions of the current legislation of Ukraine or court decisions, to ensure compliance with the terms of this Agreement. 5.5. Legal relations of the Parties not regulated by this Agreement shall be governed by the current legislation of Ukraine. 5.6. The Administrator reserves the right to unilaterally amend the terms of this Agreement periodically and without prior notice by posting a new version of the Agreement on the Razom Platform. In this case, the new terms of the Agreement shall be binding on Users from the moment of posting the new version of this Agreement, unless another date of entry into force of the changes is specified additionally when posting them.
